It is the intent of the legislature that the scope of review under AS          
38 for the sale, lease, or other disposal of available land, resources,        
property or interests in them which are subject to a best interest             
finding, including those which are phased, will include an analysis            
of the reasonably foreseeable, significant, present and future effects         
of the disposal.

It is the further intent of the Legislature that the consistency               
determination for any proposed use or activity which is phased under           
AS 46.40 of the Alaska Coastal Management Program, will include                
an analysis of the reasonably foreseeable, significant present and             
future effects of the use or activity proposed.                                
                                                                               
It is the intent of the Legislature that the sections of this legislation      
pertaining to AS 46.40 will be consistent with the federal coastal             
zone management program regulations and intent governing phased                
consistency determinations.
